QuiltRBuddy — Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a binding agreement between you and Sierra Digital Forge LLC (“we,” “us,” “QuiltRBuddy”) governing your use of the QuiltRBuddy desktop application and any associated services (collectively, the “Service”). By installing, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Signing In

QuiltRBuddy has no accounts of its own. You sign in with Google to start the free trial (section 4.4) or use a free-year key. Use your own Google account, and keep it secure.

4. Subscription

4.1 Plans and Pricing

QuiltRBuddy for Windows is a paid app, bought through the Microsoft Store:

  • Monthly: $6.99 USD per month.
  • Annual: $59.99 USD per year.

Prices are exclusive of applicable taxes, which the Microsoft Store adds at checkout.

4.2 After the Trial, and Free-Year Keys

When your free trial ends, the app shows only its renew screen until you subscribe or apply a key. Nothing you made is deleted; your projects stay on your computer.

We sometimes give out free-year keys. A key applied in the app gives you one year of QuiltRBuddy without paying. Each key works once, for one person. A free year works on up to two computers at a time; Free This PC in Preferences takes a computer off it, so you can move the year to another one.

4.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period at the then-current price. Renewing and cancelling are done in your Microsoft account, at account.microsoft.com under Services & subscriptions. Cancellation takes effect at the end of the current paid period; you keep access until that date.

4.4 Free Trial

Every new user gets a 14-day free trial of a limited version of the app. Some features open only once you subscribe. You are not charged during the trial, and nothing is charged unless you choose to subscribe. Signing in with Google starts the trial.

4.6 Price Changes

We may change subscription pricing. We will provide at least 30 days’ notice by email and in-app banner before any price change takes effect for your subscription. Continued use after the effective date constitutes acceptance.

5. Your Designs

The quilt designs, blocks and projects you make with QuiltRBuddy are yours. The Privacy Policy says where they go.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or attempt to derive source code from the Service except as permitted by law.
  • Circumvent access controls or interfere with the Service’s operation.
  • Use the Service to harvest data, send spam, or distribute unsolicited communications.
  • Resell or sublicense your subscription.

7. Intellectual Property

The Service, its design, code, and trademarks are owned by Sierra Digital Forge LLC and protected by U.S. and international copyright, trademark, and other laws. Nothing in these Terms transfers our intellectual property to you.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access for material violations of these Terms, illegal activity, or non-payment. Upon termination:

  • Your right to use the app ends immediately.
  • We will retain or delete your data as the Privacy Policy describes.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Cut-list math, yardage calculations, and 3D previews are provided as estimates and aids. You are solely responsible for verifying measurements before cutting fabric. We are not liable for fabric purchased in reliance on the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Sierra Digital Forge LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) $100 USD OR (b) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Sierra Digital Forge LLC from any claim, damage, or expense (including reasonable attorneys’ fees) arising from your use of the Service, or your violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-laws principles. Any dispute arising from or relating to these Terms or the Service shall be resolved as follows:

  1. Informal Resolution: You agree to first contact us at support@sierradigitalforge.com to attempt informal resolution.
  2. Binding Arbitration: If informal resolution fails, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with the arbitration seated in Douglas County, Nevada, except that either party may seek injunctive relief in court.
  3. Class Action Waiver: You agree to resolve disputes only on an individual basis and waive any right to participate in a class action.

(Note: arbitration + class waiver provisions are enforceable in most U.S. states but may be limited in California and a few others. Lawyer to confirm.)

13. Changes to These Terms

We may update these Terms. Material changes will be announced in-app and by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
